1. Police Report Against EC on GE13



EC has nothing to hide as Gazette is faulty.
This blog would contain all my supporting documents in the Police Report now gone public.

Police Report against Election Commission Malaysia on the misconduct and fraudulent Nation’s General Elections 13  and Sabah GE 12.

I, Joshua Kong Yun Chee of P, O. Box 11923, 88821 Kota Kinabalu residing in Kota Kinabalu, Sabah, Malaysia want to lodge this Police Report  so that the appropriate authorities investigate and take action to declare the GE13 as null and void and illegal and also declare all the Federal and State Governments already installed as illegitimate.



The causes for the declaration of the GE 13 as null and void and illegal are amongst others and the ones I consider as very important  are as follows:-



1.      The main Gazette on GE13 of 22nd May, 2013 published the Statement of the Poll after the official addition of votes by the returning officers did not include the item – Number of Ballot papers in the ballot boxes which is not in accordance to Form 16 of the Regulation 27 of the Regulatons of the conduct of General Election.  This item omitted is important in the calculation of the votes.  The Police and relevant authorities are urged to  investigate this violation.

1.1     The second Gazette (defined as corrigendum) of 31st May, 2013 with many corrections of the results as stated in Form 16 is tantamount to manipulation of the declared Election results by returning officers as the declared results on the night of polling was final and nobody else can make any changes.  The Police and relevant authorities should obtain all copies of the Form 16 to verify its accuracy with the details as published in the main Gazette.

2.      The observations of discrepancies also happen in GE13 but of different dimension with a different approach by the EC.  Such discrepancies of ballot papers issued for Parliament and the respective state seats should not arise in most seats but such discrepancies do happen as it was in GE2004 and GE2008 mainly due to manipulation of the ballot boxes and sale of ballot papers possibly to the highest bidders.  There was a report of ballot papers being sold for RM100 each but I urge the Police to investigate into this crime as the volume and value of the ballot papers sold are of much high.

2.1     There was a press report titled “Tension at counting centre over last ballot box” in the Daily Express of 6th May, 2013 that two ballot boxes (photo) from polling centre at Sacred Heart School only turned up in the counting centre in Maksak  Community Centre, Likas at about 12 am when the said school and the Maksak CC is only about ten minutes driving away.  This kind of delay strategy plus switch off lights or blackout as reported elsewhere are ballot papers and ballot boxes processes to rig the votes at counting to sway the final results.

2.2     The extremely high rate of turnouts in most seats are indicative of ballot papers frauds.

  1. The usage of indelible ink which could be washed within minutes is good enough ground to give rise to the misconduct of the nation’s 13th General Election and Sabah’s 12th General Elections as many voters could have voted more than once to distort the results. My own index finger was almost clean within hours I reached home although the first defendant claimed that indelible ink could last at least three days and not washable.  This is a crime against public interest.
  2. The EC Chairman had made a press statement titled “Sabah’s voters roll with 60,673 dubious entries still legit – EC” in Borneo Post of 1st May, 2013 after the nominations of candidates for the 13th General Elections on 20th April, 2013.  This case is now before the High Court in Kota Kinabalu hence I am NOT to discuss it here or go further on it except to state that this matter is crucial for true, fair, clean and free elections.

4.1     The EC should address the validity of the Electoral Rolls so much so that While many believe that adults of voting age with the code 71 in the identity cards are not allowed to be registered as voters but over times we have some such holders had been elected as representatives and also holders of cabinet positions in the persons of Christina Liew (NRIC 520XXX-71-52XX / H011XXX8 now elected for the state seat N15 Api-Api in Sabah and Datuk Dr. Hj Patawari bin Hj Patawe (Nric 571XXX12XX51/H6008708) who was once an Assistant minister and Nilwan Kabang – a man with NRIC 500XXX-12-5360/H008XXX9 –an even ending number in 5360- for a womanWith the ongoing RCI on illegal immigrants in Sabah and project IC, the Police and the relevant authorities that our Roll is for genuine Malaysians only.

5.  Based on the above issues and many other frauds reported, I would call for a Royal Commission of Inquiry on the Electoral System and that the present Election Commissioners be replaced with a totally independent team under an Interim Good Governance Government.

It is very important that the Police get hold of all the records and documents of the General Election 13 for full independent scrutiny.
